Terms of Service

These Terms of Service ("Terms") govern your use of ServeBuilt.com and all website design, management, and optimization services provided by ServeBuilt ("we," "us," or "our"). By subscribing to any ServeBuilt plan, you agree to these Terms in full.
1. Our Services
ServeBuilt provides AI-generated website design, local SEO optimization, managed hosting, and ongoing site management for service-industry businesses across the Austin, Houston, and Dallas-Fort Worth Texas DMAs.
Services are offered across multiple subscription tiers. Each tier includes a defined set of features covering website pages, service area coverage, SEO capabilities, hosting, support level, and optional add-ons such as custom email accounts and UI Accessibility Widgets. The specific features, limitations, and pricing for each plan are described on our pricing page at servebuilt.com/pricing, which is incorporated into these Terms by reference. Current pricing is always available at that URL.
All plans include a domain name, managed hosting, SSL security, a contact form, and Google Analytics connection. Add-ons including custom email accounts, UI Accessibility Widgets, and exclusive territory agreements are available on any plan for an additional fee as described on our pricing page.
We reserve the right to modify plan features or pricing with 30 days written notice to active subscribers. Material reductions in service may entitle you to cancel without penalty during the notice period.
2. Payment & Billing
Services are billed monthly in advance on the same calendar date each month. No setup fees are charged on any plan. All prices are in US dollars. We accept major credit and debit cards. Failed payments will trigger a 7-day grace period after which services may be suspended until payment is received. We offer a 14-day money-back guarantee on your first payment — if you are unsatisfied within 14 days of your initial launch, contact us for a full refund.
3. Cancellations, Upgrades & Downgrades
All account changes — including cancellations, plan upgrades, and plan downgrades — are processed manually via email. To request any account change, email us at hello@servebuilt.com with your business name, account email address, and the change you are requesting.
Cancellation: Either party may cancel with 14 days written notice sent to hello@servebuilt.com. Your site will remain live through the end of the current billing cycle. Upon cancellation, the website will be taken offline. We will return any business content you provided — logos, photos, and written materials — within 10 business days at no charge.
Upgrades: Plan upgrades take effect at the start of your next billing cycle unless otherwise agreed in writing. Upgraded features will be provisioned within 3 business days of confirmation.
Downgrades: Plan downgrades take effect at the start of your next billing cycle. Features included in your current plan but not your new plan will be discontinued at that time. No partial refunds are issued for the remaining days of the current billing cycle.
4. Ownership & Subscription License
What this means in plain English:
ServeBuilt builds and manages your website as a subscription service — not a one-time purchase. Your domain and email account are included as part of an active subscription. If your subscription ends for any reason — cancellation or non-payment — your website will go offline, and your domain and email will stop working and may be permanently deleted. To keep your domain or email, you'll need to either continue a paid retention plan or arrange a transfer before your service ends. We give you 30 days to decide. After that, we cannot guarantee they will still be available. Your own logos, photos, and business content are always yours and will be returned to you.
Website design, code, and content: The website, including all design, code, structure, AI-generated copy, and SEO architecture, is owned exclusively by ServeBuilt and licensed to you for use during your active subscription. This license is non-transferable and terminates immediately upon cancellation or non-payment. No source files, code exports, or design assets will be provided upon cancellation.
Your domain — client-provided: If you provide your own domain, it remains yours at all times and is unaffected by cancellation.
Your domain — ServeBuilt-registered: If ServeBuilt registers a domain on your behalf as part of your plan, the domain is registered in your name. Upon cancellation, you have three options:
- Purchase and transfer: Buy the domain outright at its current market renewal rate. ServeBuilt will provide your domain transfer authorization code (EPP/Auth code) within 5 business days so you can move it to any registrar you choose.
- Managed retention: ServeBuilt continues managing and renewing the domain for a monthly fee agreed in writing. If payment lapses at any time, the domain will stop working and may be released or permanently deleted.
- No action: If we do not hear from you within 30 days of cancellation, the domain will stop working and may be permanently deleted or released. ServeBuilt is not liable for expiration, loss, or any business impact resulting from inaction.
Custom email account: If a custom email account (e.g., you@yourbusiness.com) is included in your plan or added on, it is managed by ServeBuilt as part of your active subscription. Upon cancellation, you have three options:
- Export and close: ServeBuilt will provide a full export of your email data (messages, contacts) within 5 business days at no charge, after which the account will be permanently closed.
- Managed retention: ServeBuilt continues running the email account for a monthly fee agreed in writing. If payment lapses at any time, the account will stop working and may be permanently deleted with all data unrecoverable.
- No action: If we do not hear from you within 30 days of cancellation, the email account will stop working and may be permanently deleted. All messages and contacts may be unrecoverable. ServeBuilt is not liable for data loss, missed communications, or business impact resulting from inaction.
It is your responsibility to update any business listings, accounts, or contacts that use your domain or email address before cancellation takes effect.
Your business content: Logos, photos, trademarks, and business materials you submit remain your property and will be returned upon cancellation.
No equity or ownership accrues: Continued payment of subscription fees does not create any ownership interest in the website, its design, or its underlying code. This is a service agreement, not a purchase agreement.
5. Client Responsibilities
You agree to provide accurate and complete business information during onboarding, respond to review requests and content approvals in a timely manner, ensure you have rights to use any logos, images, or trademarks you submit, and comply with all laws and regulations governing your service business and its advertising.
6. SEO Results & Timeline Disclaimer
ServeBuilt does not guarantee specific search rankings, traffic volumes, lead counts, or revenue outcomes. Search engine rankings are determined by algorithms outside our control and are affected by competitor activity, algorithm updates, market conditions, and factors specific to your business and domain.
New domains and new websites: Websites launched on new or recently registered domains are subject to an industry-known indexing and trust-building period. Google and other search engines typically require 2–6 months to fully crawl, index, and begin ranking a new domain's pages. During this period, impressions, rankings, and organic traffic may be minimal or nonexistent — regardless of the quality of the website or its SEO implementation. This is a normal and expected part of the SEO process and does not constitute a failure of service.
Realistic expectations: Clients should expect the following general timeline for a new domain:
- Weeks 1–4: Site crawled and indexed by Google. Branded search terms may begin appearing.
- Months 1–3: Long-tail and city-specific keywords begin generating impressions. First organic traffic typically appears.
- Months 3–6: Rankings stabilize. Meaningful organic traffic and leads begin developing.
- Months 6–12: Competitive keywords and head terms begin to rank as domain authority builds.
These timelines are estimates only and may vary significantly based on competition, geographic market, industry, and factors outside ServeBuilt's control. ServeBuilt commits to implementing current industry best practices and continuously optimizing your site throughout your subscription. Any performance estimates, case studies, or examples shared by ServeBuilt are illustrative only and are not a guarantee of your specific results.
7. Non-Exclusivity & Competitive Rankings
ServeBuilt does not offer geographic or industry exclusivity unless explicitly agreed to in a separate written addendum. This means:
- ServeBuilt may provide services to multiple clients operating in the same city, region, or industry — including direct competitors in your trade and service area.
- ServeBuilt does not guarantee that your website will outrank other ServeBuilt clients or any other competitor in search results.
- Search engine rankings are determined solely by search engine algorithms and are outside ServeBuilt's control. ServeBuilt cannot and does not manipulate rankings in favor of any single client.
- Each client's website is independently optimized based on their specific business, services, coverage areas, and content. Shared platform infrastructure does not constitute a conflict of interest.
Exclusive Territory (optional add-on): Clients who require geographic and trade exclusivity may request a written Exclusive Territory Agreement. Exclusivity is offered at ServeBuilt's sole discretion, is subject to availability, and requires an additional monthly fee agreed upon in writing. Without a signed Exclusive Territory Agreement, no exclusivity is implied or granted.
8. Acceptable Use
You agree not to use ServeBuilt services to publish content that is unlawful, defamatory, or deceptive; infringe the intellectual property rights of others; make false claims about your qualifications, licenses, or services; violate consumer protection, advertising, or spam laws; or engage in any practice that could damage the reputation of ServeBuilt or the quality of our services for other clients.
9. UI Accessibility Widget Disclaimer
ServeBuilt may include a UI Accessibility Widget on select subscription plans. It is also available as a paid add-on on any plan. Availability by plan is described on our pricing page at servebuilt.com/pricing. By using this feature, you acknowledge and agree to the following:
- The UI Accessibility Widget is provided as a good-faith tool that gives visitors control over how they experience your website — including text size, contrast, font, and motion settings. It is a usability enhancement, not a guarantee of full compliance with the Americans with Disabilities Act (ADA), Section 508, WCAG 2.1, or any other accessibility standard or regulation.
- ServeBuilt makes no warranty, express or implied, that the widget will make your website legally compliant with any federal, state, or local accessibility law or regulation.
- The presence of a UI Accessibility Widget on your website does not protect you from legal claims, demand letters, or lawsuits related to web accessibility. ServeBuilt is not liable for any legal action, settlement, fine, or damages arising from accessibility-related claims against your business.
- Web accessibility compliance is a complex, evolving legal and technical area. ServeBuilt strongly recommends consulting a qualified accessibility specialist and/or legal counsel if you require verified ADA or WCAG compliance.
- ServeBuilt may update, modify, or discontinue the UI Accessibility Widget at any time without notice. No compensation is owed for changes to or removal of this feature.
Use of the UI Accessibility Widget is entirely at your own risk. ServeBuilt's total liability related to the widget is limited to the terms set out in Section 14 (Limitation of Liability) of these Terms.
10. AI-Generated Content
ServeBuilt uses artificial intelligence to generate website copy, service descriptions, city page content, and other written materials. By subscribing, you acknowledge and agree to the following:
- AI-generated content may occasionally contain inaccuracies, generalizations, or information that requires correction for your specific business. You are responsible for reviewing content and notifying us of any factual errors.
- ServeBuilt makes no warranty that AI-generated content is free from errors, omissions, or inaccuracies.
- You agree not to hold ServeBuilt liable for any consequences arising from inaccurate AI-generated content that you did not flag for correction during the onboarding and review process.
- AI technology and its outputs evolve rapidly. ServeBuilt does not guarantee that AI-generated content will remain current, accurate, or optimal as AI tools change over time.
11. Service Availability & Uptime
ServeBuilt makes reasonable efforts to maintain website uptime and hosting availability. However, we do not guarantee 100% uptime or uninterrupted service. Downtime may occur due to scheduled maintenance, hosting provider outages, security incidents, domain issues, or circumstances outside our control. ServeBuilt is not liable for lost business, leads, or revenue resulting from website downtime, regardless of cause. We will make reasonable efforts to restore service promptly in the event of an outage.
12. Google & Third-Party Platform Dependency
ServeBuilt's services rely in part on third-party platforms including Google Search, Google Business Profile, and Google Analytics. ServeBuilt has no control over changes to these platforms, their algorithms, policies, or availability. The following are outside ServeBuilt's control and do not constitute a failure of service:
- Changes to Google's search ranking algorithm that affect your site's rankings
- Google Business Profile policy changes, suspensions, or verification issues
- Google Analytics feature changes, data discrepancies, or access issues
- Changes to any third-party tool or platform that affect service delivery
ServeBuilt will make reasonable efforts to adapt to platform changes and maintain service quality, but no compensation is owed for ranking or performance impacts caused by third-party platform changes.
13. Third-Party Tools
ServeBuilt uses and may integrate third-party tools including but not limited to Google Analytics, HubSpot, Hotjar, and Web3Forms to deliver, analyze, and improve our services and yours. Use of these tools is governed by their respective terms and privacy policies. By using our services, you consent to data being processed by these tools as described in our Privacy Policy.
14. Limitation of Liability
ServeBuilt's total liability for any claim arising from or related to our services is limited to the amount you paid in the calendar month in which the claim arose. We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost leads, lost rankings, or business interruption — whether caused by service downtime, SEO performance, algorithm changes, AI-generated content, or any other factor. Our services are provided in good faith based on current best practices in web design and SEO.
15. Indemnification
You agree to indemnify and hold ServeBuilt harmless from any claims, damages, or expenses (including legal fees) arising from your use of our services, your business operations, content you provide, inaccurate business information submitted during onboarding, or your violation of these Terms or applicable law.
16. Dispute Resolution
Before initiating any legal action, both parties agree to attempt to resolve disputes informally by contacting legal@servebuilt.com and allowing 30 days for good-faith resolution. If informal resolution fails, disputes shall be resolved by binding arbitration in Texas under the rules of the American Arbitration Association, rather than in court — except that either party may seek injunctive relief in court for intellectual property violations. You waive any right to participate in a class action lawsuit or class-wide arbitration against ServeBuilt.
17. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes not resolved through arbitration shall be heard in the state or federal courts located in Texas, and both parties consent to jurisdiction therein.
18. Suspension of Service
ServeBuilt reserves the right to suspend or terminate your service immediately and without the 14-day notice required under Section 3 in any of the following circumstances:
- Non-payment or failed payment not resolved within the 7-day grace period
- Violation of the Acceptable Use policy in Section 8
- Submission of false, misleading, or fraudulent business information
- Any use of our services that exposes ServeBuilt to legal liability or reputational harm
- A court order, government directive, or legal obligation requiring suspension
In the event of suspension, ServeBuilt will make reasonable efforts to notify you by email. Suspension does not waive any amounts owed. Services will be restored upon resolution of the issue at ServeBuilt's sole discretion.
19. Price Changes
ServeBuilt reserves the right to change subscription pricing at any time. Active subscribers will receive at least 30 days written notice of any price increase before it takes effect. Price changes will be communicated by email to the address on file. If you do not wish to continue at the new price, you may cancel your subscription before the effective date without penalty. Continued use of the service after the effective date constitutes acceptance of the new pricing.
20. Service Level & Response Times
"Fully managed" means ServeBuilt handles hosting, security, technical maintenance, and SEO optimization on your behalf. It does not imply real-time response, instant changes, or guaranteed turnaround times unless explicitly agreed to in writing. Standard response times for support requests and content update requests are as follows:
- General support inquiries: within 2 business days
- Content update requests: within 5 business days
- Critical technical issues (site down): ServeBuilt will make reasonable efforts to respond as quickly as possible, but does not guarantee a specific resolution time
Response times may vary during holidays, high-volume periods, or circumstances outside ServeBuilt's control. Failure to meet these response time guidelines does not entitle the client to a refund or service credit.
21. Client-Caused Issues
ServeBuilt is not liable for service disruptions, SEO impacts, or technical issues caused by actions or omissions of the client, including but not limited to: providing inaccurate business information during onboarding or updates, unauthorized changes to domain settings, DNS records, or hosting configurations, revoking access to Google Analytics, Google Business Profile, or other connected accounts, failure to respond to time-sensitive requests from ServeBuilt, and providing content or materials that violate third-party rights or applicable law. Any remediation work required as a result of client-caused issues may be subject to additional fees.
22. Refund Policy
ServeBuilt offers a 14-day money-back guarantee on your first subscription payment only. If you are unsatisfied within 14 days of your initial site launch, contact us at legal@servebuilt.com for a full refund of that payment. After the 14-day window, all subscription payments are non-refundable. No refunds are issued for partial months, unused service periods, add-ons, domain registrations, or managed retention fees. Cancellation stops future billing but does not entitle the client to a refund of any amounts already paid.
23. Acceptance of Terms
By subscribing to any ServeBuilt plan, completing the onboarding process, or making a payment for any ServeBuilt service, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you are subscribing on behalf of a business, you represent that you have the authority to bind that business to these Terms. If you do not agree to these Terms, do not subscribe to or use ServeBuilt's services.
24. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of these Terms will continue in full force and effect. The invalidity of one provision does not affect the validity of any other provision.
25. Force Majeure
ServeBuilt is not liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond ServeBuilt's reasonable control, including but not limited to: acts of God, natural disasters, pandemic or public health emergency, power or internet outages, hosting provider failures, cyberattacks, government actions or regulations, labor disputes, or any other event outside ServeBuilt's direct control. In the event of a force majeure, ServeBuilt will make reasonable efforts to resume service as quickly as possible and will notify affected clients by email.
26. Entire Agreement
These Terms, together with any written addenda (such as an Exclusive Territory Agreement), constitute the entire agreement between you and ServeBuilt. They supersede all prior discussions, representations, or agreements relating to our services. No oral statements or representations by ServeBuilt staff constitute a binding commitment unless reflected in these Terms or a signed written addendum.
27. Changes to These Terms
We may update these Terms from time to time. We will notify active clients of material changes by email at least 30 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you may cancel your subscription before the effective date without penalty.
