Terms of Service

These Terms of Service ("Terms") govern your use of ServeBuilt.com and all website design, management, and optimization services provided by ServeBuilt ("we," "us," or "our"). By subscribing to any ServeBuilt plan, you agree to these Terms in full.

1. Our Services

ServeBuilt provides AI-generated website design, local SEO optimization, managed hosting, and ongoing site management for service-industry businesses across the Austin, Houston, and Dallas-Fort Worth Texas DMAs. The features included in your subscription depend on the plan selected:

• Starter ($247/mo) — AI-generated website up to 10 pages, 1 service area with city pages, local SEO setup, managed hosting and SSL, contact form, and Google Analytics connection.
• Growth ($447/mo) — Everything in Starter plus up to 25 pages, 3 service areas, LLM and AI search optimization, advanced schema markup, and priority email support.
• Dominate ($897/mo) — Everything in Growth plus unlimited pages, full DMA city page coverage, Google Business Profile management, review generation and automation, dedicated account manager, priority phone support, and custom integrations.

We reserve the right to modify plan features with 30 days notice. Material reductions in service will be communicated in advance and may entitle you to cancel without penalty.

2. Payment & Billing

Services are billed monthly in advance on the same calendar date each month. No setup fees are charged on any plan. All prices are in US dollars. We accept major credit and debit cards. Failed payments will trigger a 7-day grace period after which services may be suspended until payment is received. We offer a 14-day money-back guarantee on your first payment — if you are unsatisfied within 14 days of your initial launch, contact us for a full refund.

3. Cancellation

Either party may cancel with 30 days written notice sent to legal@servebuilt.com. Your site will remain live through the end of the current billing cycle. Upon cancellation, the website will be taken offline. We will return any business content you provided — logos, photos, and written materials — within 10 business days at no charge.

4. Ownership & Subscription License

ServeBuilt operates as a Website as a Service (WaaS). You are purchasing a subscription license to a managed, hosted website — not purchasing the website itself. The following applies at all times:

Website design, code, and content: The website, including all design, code, structure, AI-generated copy, and SEO architecture, is owned exclusively by ServeBuilt and licensed to you for use during your active subscription. This license is non-transferable and terminates immediately upon cancellation or non-payment. No source files, code exports, or design assets will be provided upon cancellation.

Your domain: If you provide your own domain, it remains yours at all times. If ServeBuilt registers a domain on your behalf, it will be registered in your name and you retain ownership of it regardless of subscription status.

Your business content: Logos, photos, trademarks, and business materials you submit remain your property and will be returned upon cancellation.

No equity or ownership accrues: Continued payment of subscription fees does not create any ownership interest in the website, its design, or its underlying code. This is a service agreement, not a purchase agreement.

5. Client Responsibilities

You agree to provide accurate and complete business information during onboarding, respond to review requests and content approvals in a timely manner, ensure you have rights to use any logos, images, or trademarks you submit, and comply with all laws and regulations governing your service business and its advertising.

6. SEO & Results Disclaimer

ServeBuilt does not guarantee specific search rankings, traffic volumes, lead counts, or revenue outcomes. Search engine rankings are determined by algorithms outside our control and are affected by competitor activity, algorithm updates, and market conditions. We commit to implementing current industry best practices and continuously optimizing your site. Any performance estimates or case studies shared are illustrative and not a guarantee of your results.

7. Acceptable Use

You agree not to use ServeBuilt services to publish content that is unlawful, defamatory, or deceptive; infringe the intellectual property rights of others; make false claims about your qualifications, licenses, or services; violate consumer protection, advertising, or spam laws; or engage in any practice that could damage the reputation of ServeBuilt or the quality of our services for other clients.

8. Third-Party Tools

ServeBuilt uses and may integrate third-party tools including but not limited to Google Analytics, HubSpot, Hotjar, and Web3Forms to deliver, analyze, and improve our services and yours. Use of these tools is governed by their respective terms and privacy policies. By using our services, you consent to data being processed by these tools as described in our Privacy Policy.

9. Limitation of Liability

ServeBuilt's total liability for any claim arising from or related to our services is limited to the amount you paid in the calendar month in which the claim arose. We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost leads, or business interruption. Our services are provided in good faith based on current best practices in web design and SEO.

10. Indemnification

You agree to indemnify and hold ServeBuilt harmless from any claims, damages, or expenses (including legal fees) arising from your use of our services, your business operations, content you provide, or your violation of these Terms or applicable law.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Texas, and both parties consent to jurisdiction therein.

12. Changes to These Terms

We may update these Terms from time to time. We will notify active clients of material changes by email at least 30 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you may cancel your subscription before the effective date without penalty.
